When you place an order, you are making an offer to purchase. C & J Emporium reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until C & J Emporium confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting.

All Sales Are Final: Except as explicitly set forth in our Refund & Return Policy or required by applicable provincial consumer protection law, all purchases made through C & J Emporium are final. We do not accept returns, offer exchanges, or issue refunds for change of mind, incorrect selections, or buyer's remorse once an order has been accepted and processed.

In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the email, billing address, and/or phone number provided at the time the order was made.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES, CURRENCY, AND TAXES

All prices posted on the Services are listed in Canadian Dollars (CAD) unless explicitly stated otherwise. Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email.

Posted prices do not include shipping, handling, or applicable provincial and federal taxes (GST, PST, or HST as determined by the shipping destination within Alberta, British Columbia, Saskatchewan, or other Canadian jurisdictions). All applicable taxes and shipping charges will be added to your order total at checkout.

Prices posted in our online store may be different from prices offered elsewhere. We may offer promotions that are governed by terms separate from these Terms. If there is a conflict between promotion terms and these Terms, the promotion terms will govern.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that (i) the payment information you provide is true, correct, and complete, (ii) you are authorized to use such payment method, (iii) charges incurred by you will be honored by your financial institution, and (iv) you will pay charges incurred at the posted prices, including shipping, handling, and all applicable taxes.

SECTION 5 - SHIPPING AND DELIVERY

We are not liable for shipping and delivery delays. All delivery times provided are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, severe weather, customs processing (if applicable), or events outside our reasonable control. Once we transfer products to the carrier, title and risk of loss pass to you.

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by C & J Emporium, its affiliates, or licensors and are protected by Canadian and international copyright, trademark, and intellectual property laws.

C & J Emporium is powered by Shopify Inc., which enables us to provide the Services to you. However, sales and purchases made in our store are made directly with C & J Emporium. You acknowledge and agree that Shopify is not responsible for any aspect of sales between you and C & J Emporium, including any damage or loss resulting from purchased products. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your transactions with C & J Emporium.

We may terminate this agreement or your access to the Services at our sole discretion at any time without notice. Provisions regarding Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Governing Law, and Privacy shall survive any termination.

TO THE FULLEST EXTENT PERMITTED BY LAW IN THE PROVINCES OF ALBERTA, BRITISH COLUMBIA, AND SASKATCHEWAN, IN NO CASE SHALL C & J EMPORIUM, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR LICENSORS, OR THOSE OF SHOPIFY, BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, OR REPLACEMENT COSTS ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada (or the applicable province of operation within Western Canada) and the federal laws of Canada applicable therein. You and C & J Emporium irrevocably submit to the jurisdiction of the courts located in Western Canada to resolve any legal disputes.
